The purpose of this project is to conduct a comprehensive legal analysis of the EQS system in Sweden and a number of other countries; from setting the standards, operationalising them to requirements and measures, enforcing measures and follow‐up. The analysis of the Swedish system covers all types of EQS, the effect of recent amendments of the Environmental Code and case law as well as the application in practice by supervising authorities'.
Results will be presented in a report primarily addressed to public or private actors applying the EQS legislation, and secondarily to SPEQS team members and other academics.
Studies of foreign EQS systems are made as a functional study of EQS for water in a number of EU Member States, an in‐depth study of the EQS systems for water in England as well as an analysis of EQS system for both air and water in the U.S. All comparative studies include a test of legislation in relation to a number of scenarios clarifying the legal effect in concrete situations.
The study of European EQS systems for water will be presented in an anthology, while the study of the U.S. EQS system will be presented in a peer‐reviewed article. The legal study of the English system will be included in an article produced within project 2. Based on the analysis of Swedish and other EQS legal systems within Project 1 alternative legal models will be designed, tested and evaluated within Project 6.
